What Is a Builder Registration Rule?
One of the least-known policies in new construction — and one of the most consequential. Understanding it before your first builder contact can be the difference between having representation and losing it entirely.
The Definition
A policy set by a homebuilder or community that requires a buyer to name their real estate agent before their first visit to a model home or sales center. If a buyer visits without registering an agent first — or provides contact information to the builder's sales team before an agent is registered — they may permanently lose the right to independent buyer representation in that transaction.
Builder registration rules exist because builders use them to manage agent cooperation and commission obligations. From the builder's perspective, if a buyer arrives without an agent, the builder has no obligation to cooperate with one added later. The rule is legal, enforceable, and set entirely by the builder — not by state law or a regulatory body.
Why It Matters
In many communities, walking into a model home without a registered buyer's agent — even just to look — is treated as a first contact that triggers the registration cutoff. After that point, the buyer may have no path to independent representation in that transaction, regardless of how complex the contract becomes or how much they need an advocate.
Most buyers don't learn this rule exists until they've already violated it. The builder's sales team is not required to disclose it proactively. Real estate listing platforms don't warn about it. And the rule varies enough by builder that there is no universal safe assumption.
What Triggers Registration
The specific trigger varies by builder, but common actions that may initiate registration include:
- Walking into a model home or sales center in person
- Submitting a contact form on the builder's website

- Calling the builder's sales line directly
- Attending a builder event or open house without an agent present
Any of these actions may constitute "first contact" under a builder's policy. Once first contact is established, the window to register an agent may close immediately or within a short, builder-defined period.
Do All Builders Have This Rule?
Not all builders apply registration rules the same way. Policies range from strict — requiring agent registration before any contact — to more flexible, allowing an agent to be added within a defined window after first visit. A small number of builders have no formal policy.
Because policies are set by individual builders and are not publicly standardized or regulated, buyers cannot assume flexibility without verifying. The safest approach is to have a buyer's agent identified and registered before any contact with any builder's sales process.
What to Do Before Visiting a Builder
- Identify a buyer's agent who specializes in new construction in your target market before visiting any model homes or contacting any builder.
- Confirm with your agent that they are familiar with the registration policies of the specific builders you are interested in.
- Have your agent registered or on record before your first visit — including any online contact forms or listing platform inquiries.
- Do not provide your contact information to a builder's sales team, website, or listing platform before your agent is in place.
- If you have already visited a builder without an agent, contact a buyer's agent immediately. Options may still exist depending on timing and the builder's specific policy.
